Narrated Subaia bint Al-Harith: That she was married to Sad bin Khaula who was from the tribe of Bani 'Amr bin Luai, and was one of those who fought the Badr battle. He died while she wa pregnant during Hajjat-ul-Wada.' Soon after his death, she gave birth to a child. When she completed the term of deliver (i.e. became clean), she prepared herself for suitors. Abu As-Sanabil bin Bu'kak, a man from the tribe of Bani Abd-ud-Dal called on her and said to her, "What! I see you dressed up for the people to ask you in marriage. Do you want to marry By Allah, you are not allowed to marry unless four months and ten days have elapsed (after your husband's death)." Subai'a in her narration said, "When he (i.e. Abu As-Sanabil) said this to me. I put on my dress in the evening and went to Allah's Messenger (ﷺ) and asked him about this problem. He gave the verdict that I was free to marry as I had already given birth to my child and ordered me to marry if I wished."

Al-Layth said: Yunus related to me, on the authority of Ibn Shihab, who said: ‘Ubayd Allah ibn ‘Abd Allah ibn ‘Utbah informed me that his father wrote to ‘Umar ibn ‘Abd Allah ibn al-Arqam az-Zuhri, asking him to visit Subay‘ah bint al-Harith al-Aslamiyyah and ask her about her story and what the Apostle of God had told her when she submitted her case to him. Thereupon ‘Umar ibn ‘Abd Allah ibn al-Arqam wrote to him: Subay‘ah bint al-Harith reported that she was married to Sa‘d ibn Khawlah. He belonged to the Banu ‘Amir ibn Lu’ayy and was one of those who had fought at Badr. He died at the time of the Farewell Pilgrimage while she was with child; only a few nights after his death she gave birth. When she had finished her waiting period, she dressed up for the men who came to ask her in marriage. Abu’s-Sanabil Ba‘kak, of the clan of Banu ‘Abd ad-Dar, came unto her and said: What! I see thee dressed up to ask thee in marriage, and thou thinkest of wedlock? By God! Thou art not allowed to wed until thou let four months and ten days elapse! Subay‘ah said: When he said this, I put on my outer dress in the evening, went unto the Apostle of God and asked him about this problem. He decided that I was free to marry, as I had already given birth to my child; and he allowed me to wed if I so wished. Asbagh corroborated him, on the authority of Ibn Wahb, on the authority of Yunus. Al-Layth said: Yunus related to me, on the authority of Ibn Shihab; he asked him about this problem, and he said: Muhammad ibn ‘Abd Allah ibn ‘Abd ar-Rahman ibn Thawban, a freedman of Banu ‘Amir ibn Lu’ayy, informed me that Muhammad ibn Iyas ibn al-Bukayr, whose father had fought at Badr, informed him.

وَقَالَ اللَّيْثُ حَدَّثَنِي يُونُسُ، عَنِ ابْنِ شِهَابٍ، قَالَ حَدَّثَنِي عُبَيْدُ اللَّهِ بْنُ عَبْدِ اللَّهِ بْنِ عُتْبَةَ، أَنَّ أَبَاهُ، كَتَبَ إِلَى عُمَرَ بْنِ عَبْدِ اللَّهِ بْنِ الأَرْقَمِ الزُّهْرِيِّ، يَأْمُرُهُ أَنْ يَدْخُلَ، عَلَى سُبَيْعَةَ بِنْتِ الْحَارِثِ الأَسْلَمِيَّةِ، فَيَسْأَلَهَا عَنْ حَدِيثِهَا وَعَنْ مَا قَالَ لَهَا رَسُولُ اللَّهِ صلى الله عليه وسلم حِينَ اسْتَفْتَتْهُ، فَكَتَبَ عُمَرُ بْنُ عَبْدِ اللَّهِ بْنِ الأَرْقَمِ إِلَى عَبْدِ اللَّهِ بْنِ عُتْبَةَ يُخْبِرُهُ أَنَّ سُبَيْعَةَ بِنْتَ الْحَارِثِ أَخْبَرَتْهُ أَنَّهَا كَانَتْ تَحْتَ سَعْدِ ابْنِ خَوْلَةَ، وَهْوَ مِنْ بَنِي عَامِرِ بْنِ لُؤَىٍّ، وَكَانَ مِمَّنْ شَهِدَ بَدْرًا، فَتُوُفِّيَ عَنْهَا فِي حَجَّةِ الْوَدَاعِ وَهْىَ حَامِلٌ، فَلَمْ تَنْشَبْ أَنْ وَضَعَتْ حَمْلَهَا بَعْدَ وَفَاتِهِ، فَلَمَّا تَعَلَّتْ مِنْ نِفَاسِهَا تَجَمَّلَتْ لِلْخُطَّابِ، فَدَخَلَ عَلَيْهَا أَبُو السَّنَابِلِ بْنُ بَعْكَكٍ ـ رَجُلٌ مِنْ بَنِي عَبْدِ الدَّارِ ـ فَقَالَ لَهَا مَا لِي أَرَاكِ تَجَمَّلْتِ لِلْخُطَّابِ تُرَجِّينَ النِّكَاحَ فَإِنَّكِ وَاللَّهِ مَا أَنْتِ بِنَاكِحٍ حَتَّى تَمُرَّ عَلَيْكِ أَرْبَعَةُ أَشْهُرٍ وَعَشْرٌ‏.‏ قَالَتْ سُبَيْعَةُ فَلَمَّا قَالَ لِي ذَلِكَ جَمَعْتُ عَلَىَّ ثِيَابِي حِينَ أَمْسَيْتُ، وَأَتَيْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم فَسَأَلْتُهُ عَنْ ذَلِكَ، فَأَفْتَانِي بِأَنِّي قَدْ حَلَلْتُ حِينَ وَضَعْتُ حَمْلِي، وَأَمَرَنِي بِالتَّزَوُّجِ إِنْ بَدَا لِي‏.‏ تَابَعَهُ أَصْبَغُ عَنِ ابْنِ وَهْبٍ عَنْ يُونُسَ‏.‏ وَقَالَ اللَّيْثُ حَدَّثَنِي يُونُسُ، عَنِ ابْنِ شِهَابٍ، وَسَأَلْنَاهُ، فَقَالَ أَخْبَرَنِي مُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ بْنِ ثَوْبَانَ، مَوْلَى بَنِي عَامِرِ بْنِ لُؤَىٍّ أَنَّ مُحَمَّدَ بْنَ إِيَاسِ بْنِ الْبُكَيْرِ، وَكَانَ، أَبُوهُ شَهِدَ بَدْرًا أَخْبَرَهُ‏.‏
