Narrated Hisham's father from Al-Mughira bin Shu'ba: 'Umar consulted the companions about the case of a woman's abortion (caused by somebody else). Al-Mughira said: The Prophet (ﷺ) gave the verdict that a male or female slave should be given (as a Diya). Then Muhammad bin Maslama testified that he had witnessed the Prophet (ﷺ) giving such a verdict.

حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ، حَدَّثَنَا وُهَيْبٌ، حَدَّثَنَا هِشَامٌ، عَنْ أَبِيهِ، عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ، عَنْ عُمَرَ ـ رضى الله عنه ـ أَنَّهُ اسْتَشَارَهُمْ فِي إِمْلاَصِ الْمَرْأَةِ فَقَالَ الْمُغِيرَةُ قَضَى النَّبِيُّ صلى الله عليه وسلم بِالْغُرَّةِ عَبْدٍ أَوْ أَمَةٍ‏.‏ فَقَالَ ائْتِ مَنْ يَشْهَدُ مَعَكَ، فَشَهِدَ مُحَمَّدُ بْنُ مَسْلَمَةَ أَنَّهُ شَهِدَ النَّبِيَّ صلى الله عليه وسلم قَضَى بِهِ‏.‏
